By accessing or using the Peaceful Tributes website, purchasing a product, submitting content or otherwise using our services, you agree to be bound by these Terms of Service and any policies referred to in these Terms.

If you do not agree with these Terms, you should not use the website or place an order.

2. Online Store Terms

You may only use our website and services for lawful purposes.

By placing an order, you confirm that you have legal capacity to enter into the transaction or have the permission of a parent or legal guardian where required by law.

You must provide accurate, complete and current information when placing an order, including your name, billing information, delivery address and contact details.

You are responsible for maintaining the confidentiality of any account credentials associated with your use of the website.

3. Products and Descriptions

Peaceful Tributes makes reasonable efforts to ensure that product descriptions, photographs, dimensions, colours, prices and other information displayed on our website are accurate.

Because products are photographed and viewed on different screens, minor differences in colour, brightness, positioning, texture or appearance may occur.

Minor variations resulting from normal printing or production processes may also occur and are not necessarily product faults.

Product photographs may contain decorative props or accessories that are not included unless specifically stated in the product description.

Where an acrylic display stand is supplied with a product, the exact shape, size, thickness or style of the stand may vary from photographs while still performing its intended display function.

4. Orders and Acceptance

Submitting an order through our website is an offer to purchase the selected products.

Receipt of an automated order confirmation does not necessarily mean that we have accepted the order for fulfilment.

We may contact you if there is a problem with an order, including where:

• A product or required material is unavailable
• An obvious pricing or website error has occurred
• Payment cannot be authorised
• Required personalisation information is missing
• Customer-supplied content cannot reasonably be used
• We cannot deliver to the address provided
• The order appears fraudulent or unlawful

If we cannot reasonably fulfil an order, we may cancel the affected item or order and refund any amount paid for the cancelled item.

We will not substitute a materially different product or charge an increased price without your agreement.

5. Pricing and Payment

Prices are displayed in Australian dollars unless otherwise stated.

The total price payable, including applicable shipping charges, will be displayed during checkout before you complete your purchase.

Payment must be made using one of the payment methods offered at checkout.

We may change product prices at any time. Price changes do not normally affect orders that have already been accepted, except where an obvious pricing or technical error has occurred and the order has not yet been fulfilled.

Promotional codes, discounts and special offers are subject to any conditions stated with the promotion.

6. Personalised and Custom Products

Customers are responsible for checking all names, dates, spelling, punctuation, wording, photographs and other personalisation details submitted with an order.

Information will generally be printed as supplied or as approved by the customer.

Where we provide a digital proof, you must carefully check the entire design before approving it. Approval authorises Peaceful Tributes to proceed with production.

If you discover an error after placing an order, contact us as soon as possible. We may be able to make changes before production begins, but changes cannot be guaranteed once production has commenced.

Personalised, customised or specially made products cannot normally be cancelled or returned for change of mind once design work or production has begun.

This does not affect your rights where an item is faulty, damaged, incorrect, not as described or contains an error made by Peaceful Tributes.

7. Shipping and Delivery

Production and dispatch times are separate from carrier delivery times. Delivery estimates are provided as a guide and are not guaranteed delivery dates.

Customers are responsible for providing a complete and accurate delivery address.

Where tracking is available, tracking information will generally be provided after dispatch.

Delivery may be affected by circumstances outside our reasonable control, including carrier disruptions, severe weather, natural disasters, public holidays, industrial action or transport disruptions.

If an order appears to be lost or significantly delayed, please contact us so that we can assist with an appropriate carrier enquiry.

8. Returns, Refunds and Consumer Rights

Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product is faulty, unsafe, not of acceptable quality, not fit for its stated or agreed purpose, or does not match its description.

Peaceful Tributes does not generally accept returns, exchanges or refunds solely because a customer changes their mind.

Our change-of-mind policy does not limit any rights you have under the Australian Consumer Law.

9. Website, Product and Pricing Errors

We take reasonable care to keep our website information accurate, but errors may occasionally occur.

You must not reproduce, manufacture, copy, distribute, republish, sell, modify or commercially exploit protected Peaceful Tributes material without prior permission from Peaceful Tributes or the relevant rights holder.

11. Customer-Supplied Images and Content

When you submit photographs, images, wording, logos, artwork or other material for a custom product, you confirm that you own the material or have sufficient permission or authority to provide it to us for the requested purpose.

You are responsible for ensuring that material you submit does not unlawfully infringe another person's copyright, trade mark, privacy or other rights.

You grant Peaceful Tributes a limited permission to store, edit, reproduce and print the supplied material only as reasonably necessary to design, manufacture and fulfil your order.

Customer-supplied personal photographs will not be used in public advertising or promotional material without permission.

We may refuse customer-supplied content where we reasonably believe it is unlawful, threatening, abusive, discriminatory, misleading or likely to infringe another person's rights.

12. Prohibited Use

You must not use our website or services to:

• Commit or encourage an unlawful act
• Submit false, fraudulent or misleading information
• Infringe intellectual property or privacy rights

Decorative tiles and plaques may be fragile and should be handled with appropriate care.

Unless specifically stated otherwise, our decorative products are not intended to be used as structural materials, flooring, food preparation surfaces, children's toys, heat-resistant trivets or load-bearing products.

15. Your Responsibility

You are responsible for information, photographs, artwork and other material you knowingly submit to Peaceful Tributes.

Where your deliberate unlawful use of our services or unauthorised use of another person's protected material directly causes Peaceful Tributes to suffer loss, you may be responsible for that loss to the extent permitted by law.

Nothing in this section creates liability where imposing that liability would be unfair or unlawful.

16. Suspension or Termination of Access

We may suspend or restrict access to our website where reasonably necessary because of suspected fraud, unlawful activity, security concerns, serious misuse of the website or repeated material breaches of these Terms.

Any suspension or termination does not remove rights or obligations that arose before the suspension or termination.
